While some companies, like Apple, market themselves as privacy-friendly, others, such as Meta, rely on data-driven advertising as their primary revenue source. This creates a clear conflict — your data fuels their profits.

Even when companies say you “own” your content, such as photos or posts, the picture is more complicated. Data like your location, device usage, or browsing behaviour is rarely framed as your property. Instead, companies treat these digital traces as assets they control, with or without your ongoing involvement. This distinction between content ownership and data control lies at the heart of digital privacy debates.

This confusion leaves consumers vulnerable. Most people assume they own what they create, but modern platforms often claim rights to the surrounding data. While laws in the US and UK offer some protections, the average user has limited awareness of how much control they’ve already handed over. This imbalance between user expectations and corporate reality is a growing source of friction in both technology and regulation.

Emerging tools like artificial intelligence (AI), Internet of Things (IoT) devices, and biometric scanners are constantly expanding the types of data being collected — often without explicit consent or user understanding. These technologies operate quietly in the background, gathering personal insights long before users know what’s happening.

AI systems are particularly invasive. They thrive on large datasets, often combining personal data with predictive modelling. AI can infer hidden traits from your behaviour, like your health risks or political preferences. Beyond the platforms and devices users interact with directly, a hidden industry of data brokers trades personal information on a massive scale. These companies gather data from public records, online tracking, loyalty programmes, and commercial purchases, building detailed profiles on millions of people. Most consumers have no idea these companies exist, yet their data fuels an invisible economy of targeted marketing, risk scoring, and decision-making.

Many brokers rely on opacity and loopholes to keep profiles alive, knowing most consumers lack the time or expertise to challenge them effectively.

This thriving data broker industry highlights a core flaw in current privacy approaches — regulations tend to focus on platforms users can see, like social networks, but do far less to control the invisible trade happening behind the scenes. Until governments impose stricter transparency and legal obligations on the data broker ecosystem, users’ data will continue circulating in ways they neither expect nor approve.

Reclaiming your data and reshaping the future of ownership

Despite these challenges, users still have ways to regain some control over their data. Stronger laws are emerging, public awareness is growing, and some companies are beginning to offer meaningful privacy controls in response to consumer demand. However, legal protections alone will never be enough—real data ownership also requires users to change their own habits.

The first step is to treat personal data as valuable rather than something to trade for convenience. Reviewing privacy settings, limiting unnecessary data sharing, and switching to privacy-focused tools—such as encrypted messaging apps, privacy-first browsers, and tracker-blocking extensions—can significantly reduce the data trails you leave behind. These small steps collectively rebuild personal control over your information.

At the same time, companies must adopt privac-by-design building products where strong privacy settings are enabled by default and are not buried in complicated menus. Privacy should become part of the product experience, not an afterthought. Governments also need to stay ahead of innovation, ensuring that new technologies — from AI profiling to smart city surveillance — are regulated before they reshape society in ways that undermine privacy altogether.

Ultimately, the future of data ownership will depend on a combination of law, technology, and user behaviour. When users demand transparency, governments enforce real accountability, and companies innovate with privacy in mind, personal data can once again become something individuals actively control.
